US Commerce Department Cancels Proposed Regulation on AI Chip Exports

The US Commerce Department revoked a proposed regulation concerning artificial-intelligence chip exports, marking the Trump administration's latest retreat in its attempts to foster secure American AI leadership.

Last month, the department dispatched a proposed rule to other agencies for input, intending to substitute a Biden-era regulation from January 2025 regarding worldwide availability of AI chips.

A notification regarding the "AI Action Plan Implementation" rule was published on the Office of Information and Regulatory Affairs website on February 26, indicating that the rule was under review, but it was removed on Friday.

"This alleged rule has always been a draft and continues to be a draft," according to reports.

"All discussions that were reported earlier were preliminary." Last spring, the Commerce Department announced plans to discard and substitute the Biden-era rule with a more straightforward one aimed at guaranteeing American AI supremacy, yet no new regulations emerged.

The most recent draft from Trump contemplated mandating foreign nations to invest in US data centers or provide security assurances as a prerequisite for permitting exports of 200,000 chips or more, based on a document reviewed by Reuters last week.

The document stated that foreign companies seeking up to 100,000 chips must offer assurances from government to government.

The strategy significantly diverged from the Biden method, which categorized the globe into three levels: allies who could access limitless chips; a large portion of the world facing restrictions; and nations of concern that were prohibited from obtaining the prized chips.

 

The Biden rule concluded a four-year initiative by that administration to restrict China's access to advanced chips while preserving US dominance in AI.

A previous official stated on Friday that the retraction of the most recent proposed regulation probably indicates conflicting opinions within the Trump administration regarding the pursuit of global AI dominance and the management of national security issues.
